The company is demanding that Elon Musk cease his continuous attacks and withdraw the "fake acquisition offer" he made to acquire OpenAI. In the lawsuit, OpenAI's lawyers emphasize that Musk's ongoing "attacks" have seriously harmed the company's future, and such "illegal and unfair actions" must be stopped. The company also aims to hold Musk accountable for the financial damage and losses his actions have caused.

OpenAI's leadership describes Musk's behavior as "unreasonable tactics," stating that the primary goal behind these actions is to delay OpenAI's progress and seize control of crucial innovations in artificial intelligence for personal gain.

Elon Musk was one of the original founders of OpenAI and filed a lawsuit against the company in the spring of 2024, attempting to steer it back towards its mission of developing AGI (Artificial General Intelligence) for the benefit of humanity. The lawsuit was initially withdrawn in June 2024, but it was refiled in August. The legal proceedings are scheduled for the spring of 2026.

In February 2025, Elon Musk offered $97.4 billion to purchase OpenAI, stating that the company should return to its original open-source model. However, OpenAI rejected the offer, deciding to continue with its own strategy for the company's future.
