Elon Musk loses lawsuit against OpenAI and Sam Altman

Elon Musk's lawsuit against OpenAI and its executives has been dismissed. In a trial in Oakland, California, a jury unanimously ruled that Musk filed the lawsuit too late to bring the lawsuit against the company.

Musk accused OpenAI of turning from a public-benefit nonprofit into a for-profit company, straying from its original mission. However, the court rejected this argument.

The trial has been ongoing since late April 2026. Musk's lawyers, Sam Altman and Greg Brockman, accused him of turning OpenAI's nonprofit structure into a business serving personal interests.

Musk initially demanded financial compensation, but later demanded that these funds be directed to the nonprofit division of OpenAI. He also demanded that Altman and Brockman be removed from the board.

OpenAI's side, however, called Musk a "jealous competitor" and said that he left because he could not gain full control of the company. Elon Musk is currently developing his own artificial intelligence company called xAI.

With the ruling, OpenAI, the company's executives, and Microsoft, one of its early investors, were cleared of legal liability for Musk's main claims.
