The list of objects aimed at destroying, damaging or disrupting the normal functioning of life support and critical information infrastructure facilities, energy and transport infrastructure, telecommunications networks, enterprises, and facilities is expanding in order to weaken the economic security and scientific and technical potential of Azerbaijan.
The issue in question is reflected in the draft amendments to the "Criminal Code of the Republic of Azerbaijan" and the Law "On Combating Terrorism" that were put to the discussion in the Committee on Defense, Security and Combating Corruption of the Milli Majlis.
The punishment for explosions, arson, mass poisoning, spreading infectious diseases, or other actions aimed at destroying, damaging or disrupting the normal functioning of life-support and critical information infrastructure facilities, energy and transport infrastructure, telecommunications networks, enterprises, facilities, or causing harm to the health of the population and the environment, or for the same purpose using artificial intelligence technologies, as well as special software, or other actions, is determined by deprivation of liberty for a term of 8 to 15 years.
Also, a number of new aggravating circumstances are envisaged when the same acts are committed by an organized group.
These aggravating circumstances include the commission of the provocation by a criminal association, a state of emergency or martial law, a social emergency environmental regime, as well as when committed during mass riots, committed by a person using his official position, causing death or other serious consequences through negligence.
Also here, a person participating in the preparation of a provocation will be exempted from criminal liability if he helps prevent such an act by timely notifying the authorities or in another way, and if his act does not constitute another crime.
